Introduction

The LOEWE FOUNDATION (with tax identification number G-78772266 and registered office at calle Goya no. 4, Madrid 28001, Spain, and registered as a private cultural foundation in the Registry of the Ministry of Education, Culture and Sports) is an entity whose purpose is to promote, develop, protect and foster all kinds of cultural studies and activities, with a special focus on music, poetry, dance, crafts and design.

The LOEWE FOUNDATION has held its annual “LOEWE FOUNDATION Craft Prize” (the “Competition”) since 2016, to disseminate global artisanal talent and work, to contribute to artistic culture and innovation, in accordance with the Competition's current Terms and Conditions for this year.

In order to give greater exposure to the works presented by the Finalist Artists in the Competition, the LOEWE FOUNDATION, in collaboration with Palais de Tokyo in Paris, has created a website (hereinafter, the “Website”, or the “Site”), which will allow Users to access the Virtual Exhibition “LOEWE FOUNDATION Craft Prize 2024”.

The Craft Prize is an internet domain owned by LOEWE (with tax identification number A-28003861 and registered office at calle Goya no. 4, Madrid 28001, Spain), and the LOEWE FOUNDATION referred to indistinctly as ‘Loewe’.

1. Acceptance of the terms

Loewe provides the Platform and related services to Users in accordance with the following Terms of Use.

By using the Platform, Users expressly accept all the rules of these Standard Terms as well as, if applicable, any specific Terms that may be added and any future revision of them.
This Website has been created by Loewe for information purposes and for free and personal use by the user. The access and use of the contents of the Website are the exclusive and sole responsibility of the user and imply the user's knowledge and acceptance of the following terms.

By accessing this website and its subdomains, Users agree to be bound by the following terms and conditions, which Loewe may revise at any time.

2. Copyright

All the Website, texts, graphics, images, videos, their design and the intellectual property rights that may correspond to the contents, as well as all trademarks, commercial names or any other distinctive sign appearing on the Website, are the property of Loewe or of their legitimate owners, and all rights over them are reserved and are protected by the corresponding intellectual and industrial property rights.

In accordance with sections 8 and 32.1, paragraph two, of the Spanish Intellectual Property Act, the reproduction, distribution, transformation, manipulation, public communication or any other act of total or partial, free or onerous exploitation of the texts, images or any other content appearing on the website is strictly prohibited without the written authorisation of the copyright holders.

Loewe reserves the right to make, at any time and without prior notice, any modifications, variations, deletions or cancellations to the contents or their form of presentation it considers necessary, either temporarily or permanently, and the User must ensure that they use the updated version at all times. This does not entitle Users to any right to compensation for loss.

The Website is made available for non-commercial, research or educational use only. Users may only use this content for the above purposes and for their personal use, subject to any additional conditions or restrictions that may be applicable to each file. In this case, Users must always cite (i) the author and/or the applicable copyright holder, (ii) the source of the materials, and (iii) the URL.

3. Use of the Website and Access to Content

Loewe accepts no liability for any consequences, loss that could arise from the use of this website or its contents, with the exception of any actions stemming from the application of the mandatory legal provisions that Loewe must abide by in the course of its business.

Loewe will not be responsible for the opinions expressed by users on Loewe’s business or on the content of this Website through forums or other participation tools that may be developed.

5. Contract, law and jurisdiction

These Terms of Use are considered a legally binding contract between the parties and are subject to Spanish law. Any change to these Standard Terms owing to legal or business issues will be published on the website. The user will be subject to the terms in force when they access the Platform.

Any dispute relating to the validity, interpretation or performance of these rules will be referred to the courts of Madrid.Should any element of these terms be rendered invalid, illegal or inapplicable under any rule or law, that element will be considered amended to retain the closest original intention as possible, and the remaining provisions of this Agreement will consequently remain unaffected and unharmed.

6. Privacy

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, hereinafter GDPR) and Organic Law3/2018, of December 5th., on the Protection of Personal Data and guarantee of digital rights, Loewe undertakes to comply with its obligation of secrecy with respect to personal data and the duty to treat them with confidentiality. For these purposes, it will adopt the necessary measures to avoid their alteration, loss, treatment or unauthorized access. Loewe has established all the technical means at its disposal to prevent the loss, misuse, alteration, unauthorized access and theft of the data provided by users.

On behalf of the citizen, the visit to the website is made anonymously. Users must only provide the personal data necessary to access those web services that have specific management or procedures for the provision of the requested service (pe, contact forms, newsletters, other).These data will be incorporated into the corresponding processing activities of Loewe and will be processed for the specific purpose of each process in accordance with the regulations established by the GDPR on the protection of personal data and other applicable provisions.The legitimacy of the processing may be based on the consent of the data subjects and/or the performance of a legal obligation and/or the performance of a task carried out in the public interest and/or the protection of vital interests and/or the performance of a contract, as set out in Article 6 of the GDPR.
